Confidentiality in Mediation

At Cavass, confidentiality is central to the mediation process. Whether you’re a homeowner or a builder/contractor, you can be confident that everything shared remains private and protected.
Mediation is a voluntary and confidential process. Our mediators are impartial professionals registered with appropriate bodies and operate in line with the Civil Mediation Council’s Code of Conduct. Information disclosed during mediation — including private one-to-one discussions (known as caucus meetings) — will not be shared with the other party without your express permission.
Nothing said in mediation can be used later in court, should the dispute continue. This legal safeguard encourages open, honest dialogue and helps both parties explore realistic solutions without fear of judgment or future disadvantage.
Any written settlement or Heads of Agreement can also remain confidential, subject to mutual consent. Mediation sessions are not recorded, and audio/video recording is not permitted.
Our role is to create a safe and respectful environment where both sides can speak freely, be heard, and work toward a fair resolution. Trust and discretion are fundamental — and you can rely on Cavass to uphold both at every stage.
